Membership Code of Conduct
This written Code of Conduct shall govern the performance and actions of all active PRFSD members, to include the PRFSD Board of Directors, its officers, bid committee members, industry partners or representative who are engaged in any aspect of procurement, contracts, or the administration and supervision of procurement contracts. Members shall not engage in activities which violate federal, state or local laws or which, in any way, diminish the integrity, efficiency or discipline of the organization.
- PRFSD members shall conduct all of their activities professionally and with integrity. PRFSD members shall take great care to be completely objective in judgment and any recommendations that are given, so that issues are never influenced by anything other than the best and proper interests of our organization.
- PRFSD members shall not participate in the selection, award or administration of a bid or contract if a conflict of interest is real or apparent to a reasonable person.
- Conflicts of interest may arise when any PRFSD Board of Director, officer, bid committee member, industry partner or representative has a financial or beneficial interest in the vendor firm selected or considered for an award.
- No PRFSD Board of Director, officer, bid committee member, industry partner or representatives shall do business with; award bids to; or show favoritism toward a member of (his or her) immediate family, spouses family or to any company, vendor or concern who either employs or has a relationship to a family member; or award a bid which violates federal, state or local procurement laws and policies established to maximize free and open competition among qualified vendors.
- PRFSD members shall neither solicit nor accept gratuities, gifts, trips, consulting fees, favors or anything having a monetary value from a current or potential vendor or bidder for personal benefit. Items of this nature accepted from a current or potential vendor or bidder shall be accepted only for use as a direct benefit to the District’s Child Nutrition Program (ex. samples, educational points programs, participation promotions, etc.).
- PRFSD members will adhere to the following: The U.S. Department of Agriculture (USDA) prohibits discrimination in all its programs and activities on the basis of race, color, national origin, religion, sex, gender identity (including gender expression), sexual orientation, disability, age, marital status, familial/ parental status, income derived from a public assistance program, political beliefs, reprisal or retaliation for prior civil rights activity. (Not all prohibited bases apply to all programs.) Program information may be made available in languages other than English. Persons with disabilities who require alternative means of communication for program information (e.g., Braille, large print, audiotape, and American Sign Language) should contact the responsible Mission Area, agency, staff office, or USDA’s TARGET Center at (202) 720-2600 (voice and TTY) or contact USDA through the Federal Relay Service at (800) 877-8339. To file a program discrimination complaint, a complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form, which can be obtained online, at www.usda.gov/sites/default/files/documents/usda-programdiscrimination-complaint-form.pdf, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant’s name, address, telephone number and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. - Members are expected to comply with the above principles and policies in this Code. Failure to comply with the above policies and procedures contained in this Code will mean automatic termination of PRFSD bid privileges and PRFSD organizational membership. Suspected instances of inappropriate conduct will be investigated and decided upon by the PRFSD Board of Directors. Confirmed instances will be brought to the attention of PDE’s Division of Food and Nutrition as required by federal procurement regulation 2 CFR, Section 400.2.
